DHDTC DAL 18-03: Patient Rights Update Alert

Dear Hospital CEO and Diagnostic & Treatment Center Clinic Administrator:

The purpose of this letter is to alert you to updated and recently composed publications on the New York State Department of Health's (Department) website.

Per Public Health Law Article 28 Section 2803, clinic operators are required to provide a patients' bill of rights for those who receive their healthcare from a Clinic in New York State using the text written within 10NYCRR Title 10, Section 751.9. To prevent error and incorrect modification, the patients' rights for clinics are now formatted as a formal publication called "Patients' Bill of Rights for Diagnostic and Treatment Centers (Clinics)" (publication #1515) at the following links:

The Clinic operator shall post the Department's publication in patient care areas, in addition to a copy given to the patient. It shall be in clearly viewed areas of your clinic, at readable heights for all patients to read, to include patient examining rooms and waiting areas. Only reproductions using the Department's electronic file provided in the website abovecan be posted and/or distributed to patients visiting your facility.

In addition, the English version of "Your Rights as a Hospital Patient in New York State" booklet (#1449) and "Deciding About Health Care – A Guide for Patients and Families" within the booklet (#1503) has been updated and can be accessed via the following links:

Translations of the entire booklet in the other six languages will be forthcoming. Finally, below is a link to additional details on the Hospital Patients' Bill of Rights:

Should you have questions about the above publications, please contact the Division of Hospitals and Diagnostic & Treatment Centers at (518) 402-1004 or by email at https://apps.health.ny.gov/surveyd8/email-hospdtc.

Sincerely,

Ruth Leslie
