Regulatory Waivers and Projects - Background

  • Public Health Law allows regulations to be waived to allow efficient implementation of proposed projects, provided public safety not adversely affected.
  • In March 2015 and January 2016 PPS were awarded temporary waivers for a variety of regulations. Members from OPCHSM, OMH, OASAS, and OPWDD were part of the review panel that evaluated the PPS´ requests. Over 280 regulatory waivers were approved as being waived.
  • Letters issued to PPS are not provider or site specific.
  • PPS must complete the Regulatory Wavier & Project Tracking Tool to indicate exactly which of their providers are linked to each approved regulatory waiver.
  • Letters will then be issued to those indicated providers so they have evidence of waiver in the event of survey/inspection.
  • Projects- CON/PAR Applications-agencies need list of DSRIP projects to expedite

What is the Regulatory Waiver & Project Tracking Tool?

  • The Regulatory Waiver & Project Tracking Tool is an Excel document, developed by DOH, to be used by PPS for two purposes:
    1. To track which providers (within their networks) have been approved for regulatory waivers.
    2. To track which providers have/are submitting CON/PAR applications under DSRIP.
  • The Regulatory Waiver & Project Tracking Tool is not another application - it is a method to record and catalogue all provider sites that align to the waivers that the PPS had previously been approved for during the PPS Lead Regulatory Waiver Requests rounds one and two.
  • The Regulatory Waiver & Project Tracking Tool should be:
    • Easy to use
    • Standardized across all PPS
    • Effective in recording all provider-level & site alignment by regulatory waivers
    • Easy to analyze and act upon by DOH and its agencies

Frequently Asked Questions

How does a PPS submit a completed Regulatory Waiver & Project Tracking Tool to DOH?

A: In the Tool´s instructions tab, it states that, once completed, it should be sent to DSRIP@health.ny.gov with "DSRIP Regulatory Waiver & Project Tracking Tool" in the subject line.

Can any public health regulation be entered into the Tool?

A: No, only regulations that the PPS has received approval for can be entered.

Does the PPS itself have to complete the whole Tool, or can it delegate the work?

A: A PPS can delegate the completion of the Tool across its hubs or provider groups, but the PPS PMO team is responsible for compiling the completed files, reviewing them for completeness and accuracy, and submitting them to DOH as one bundle.

Will PPS have another opportunity to submit the Tool to DOH?

A: The Tool will be available to be resubmitted to DOH with new providers on an ongoing basis throughout the duration of DSRIP. DOH will let PPS know whenever the Tool can be updated and resubmitted.

When is the Regulatory Waiver & Project Tracking Tool going to be released to PPS?

A: The Tool will be available to all PPS on the Digital Library by this coming Monday, August 8th, 2016.

When will the completed Tool be due back to DOH?

A: The due date for the completed Tool to be submitted to DOH is 90 days after its release, on November 8th, 2016.

What if I can´t find a provider in the tab I would expect it to be located in?

A: providers were generally placed in the tab of their primary provider type for DSRIP (e.g. hospital, nursing home, etc.). If a provider was given two or more DSRIP provider types, be sure to check all of the provider type tabs within the Tool that might apply to them.

What if I can´t find a provider on any tab in the Tool?

A: In the unlikely case that a provider in a PPS´s network is not in the Tool, a PPS can use the ´Missing Provider´ Tab to include the provider´s details.

What if one provider requires more than one regulation to be waived?

A: Enter in the provider on multiple rows, and list one regulation in each row.

What if one provider requires more than one DSRIP-related application to be expedited?

A: Enter in the provider on multiple rows, and list one Application in each row.

What if a provider requires regulatory waivers, but does not require DSRIP-related applications to be expedited?

A: Leave the application columns blank - only fill in the provider detail columns and the regulatory waiver columns.

What if a provider requires DSRIP-related applications to be expedited, but does not require any regulatory waivers?

A: Leave the regulatory waiver columns blank - only fill in the provider detail columns and the application columns.

Why do some citation numbers have asterisks (*) after them within the Regulatory Waiver & Project Tracking Tool?

A: Citation numbers within the Tool that have asterisks are for denoting regulatory waivers that the PPS was approved for on a case-by-case basis, or on the condition that more information was submitted.

DOH will note these asterisked cases once the Tools are submitted, and will only release waiver letters to the providers once the additional required information has been received and approved.
