Single Source Procurement: HIV-1 RNA Test Kits

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. Hologic Gen-Probe is the sole manufacturer and distributor of the Aptima HIV-1 RNA and Aptima QL Auto Detect Reagents. Due to proprietary technology, software, and the instrumentation required to perform the HIV-1 RNA testing, the Aptima kits and reagents can only be used in conjunction with Hologic’s DTS 400 System currently in house at Wadsworth Center. No other alternative exists. Hologic has provided a sole source statement regarding their unique patent, proprietary technology, and the exclusive availability specific to these items.
