Single Source Procurement: Regional Resource Development Centers/Traumatic Brain Injury Medicaid Waiver/Nursing Home Transition and Diversion Medicaid Waiver Program

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The New York State Department of Health Regional Resource Development Centers/Traumatic Brain Injury Medicaid Waiver/Nursing Home Transition and Diversion Medicaid Waiver Program has made a determination to issue a Single Source Procurement to one eligible grantees to support ongoing currently funded projects.

The Regional Resource Development Center (RRDC) is responsible for the oversight and implementation of the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) 1915(c) Medicaid waiver programs.

A statewide Request for Applications (RFA) # 17782 was issued on September 4, 2018 to procure contractors to serve as RRDCs for a five-year term. The Department received bids for all regions, except New York City. Upon receiving no applications for the NYC region in response to the RFA, the Department canvassed the solicitation list. As a result of the canvass, potential applicants presented responses such as “not interested at this time.” In response to this inquiry, the mailing list was assessed and increased to include potential bidders outside of New York City that would potentially have the capacity to serve as the NYC RRDC. Subsequently, another RFA (18146) was re-issued. At the close of the re-issue, only one application was initiated, but not completed.

A no-bid canvass was also issued following the close of the reissue. This canvass resulted in four email responses and one phone response. The email responses were from two entities that were not interested in serving as the RRDC, indicating that the services were out of the scope of their organizations; one entity indicated it would be interested, but not in the indicated contract term; and the current contractor, Visiting Nurse Association Health Care Services, Inc (VNA-SI) indicated there was inadequate notice for the reissue. The current Lower Hudson Valley RRDC contractor, Westchester Independent Living Center (WILC) responded to the no-bid canvass indicating they would be interested and able to serve the NYC region.

WILC has served as a RRDC contractor beginning with the TBI waiver program over twenty years ago. It has provided a critical role in the continuation of the TBI waiver program and the initial development of the NHTD waiver. Staff from this organization have assisted in the training of other RRDC staff across the state and continues to promote RRDC best practices. They have demonstrated both sufficient administrative and fiscal stability to effectively serve as the RRDC for a large region. The organization’s performance history indicates the ability and resources to successfully serve as the RRDC for the New York City region.

WILC was competitively awarded the RRDC contract for the Lower Hudson Valley in two consecutive RFAs. They have proven that they exceed competitors when applying for grants, particularly for RRDC services. The organization is currently contracted to provide several long-term care services through DLTC. Considering the lack of interest from other organizations and the success of their current operations, WILC would be the best selected contractor for the New York City RRDC.
