Single Source Procurement: Statewide Coordination of LGBT Health and Human Services

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The Empire State Pride Agenda (ESPA) was selected to provide statewide coordination of the Health and Human Services for LGBT contractors under component C of DOH01-0000399-3450000. They were the only applicant that applied under component C of that procurement. Their contract was recently enhanced via a CRER request DOH01-0000809-3450000 for social media training and technical assistance and PrEP campaign at Gay Pride events. ESPA has informed DOH that it will be ceasing operations as of 2/29/16 and terminating their contract with us.

DOH is requesting to transfer their programs to Lesbian and Gay Community Services Center. This selection was made, by considering all of the AIDS Institute providers funded to provide LGBT services in New York State, that were capable of doing state wide coordination of the Health and Human service initiative. This short list was then evaluated using the criteria The State deemed necessary to be successful in this endeavor. Lesbian and Gay Community Services Center was the only provider to meet each one of these criteria.

Contractors were awarded contract(s) as a result of the competitive procurement process. This is a 17 month transfer of the contract under the same terms, conditions, and pricing authorized under the existing contract(s). The single source transfer will allow for the continuation of critical services pending outcome of a new competitive procurement to obtain these services.
