Actuarial Rate Certification Services and Support Amendment X-1

Pursuant to New York State Finance Law §163.10(b), the New York State Department of (DOH) is presenting the following summary of relevant circumstances and substantial reasons why a competitive procurement was not feasible.

Through C036859, Deloitte provides actuarial certification and support services for several Managed Care and Service Based Payment Programs, as well as delivers fiscal management and consulting services related to various Department initiatives. This amendment will add funds to support the addition of new rate package deliverables and an increased volume of hourly task order consulting work, which were not anticipated prior to the contract’s start.

As these programmatic changes were not foreseen and accounted for under the initial Request for Proposals (RFP) the Department released to secure this contract, this amendment will allow Deloitte to continue to provide actuarial services, ensuring consistent rate setting methodologies are applied across all programs. The amendment will also allow Deloitte to continue providing consulting work for priority Department initiatives currently underway.

The New York State Office of the State Comptroller’s Bureau of Contracts on February 14, 2024 approved a request for exemption from giving notice in the New York State Contract Reporter for the Actuarial Rate Certification Services and Support from Deloitte Consulting, LLP.

Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
