Single Source Procurement: Legal Representation and Advisory Services

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. To evaluate the potential bidding community able to provide these services, the Department posted an advertisement on the New York State Contract Reporter on February 27th, 2019 for a three-week period. The advertisement consisted of a scope of work and minimum qualifications and requested interested parties to respond according to the specifications of the advertisement. Brown & Peisch was the only organization who responded. B & P’s response met the minimum qualifications of the advertisement and was able to successfully demonstrate how the firm has been completing similar scopes of work in multiple state governments throughout the nation. The contractor will provide legal representation and advisory services related to federal law and rules related to aspects of the Medicaid program.
