Single Source Procurement: ISTOP Fraud Framework License/Maintenance Agreemente

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. This is a Sole Source procurement for the SAS Fraud Framework (SFF) and Visual Analytics (VA) “Maintenance Agreement”. This Agreement includes both maintenance and the software license. SAS software is unique, as attested to by the SAS Institute. “SAS Institute Inc. (“SAS”) is the sole manufacturer and publisher of SAS software (the “Software”) in the United States. For government customers located in the United States, SAS is the sole source for new Software licenses, excluding licenses for JMP software…” As such, the license renewal for SFF and VA software (Annual Maintenance) can only be purchased from SAS Institute through Executive Information Systems (EIS), the only New York State approved vendor for SFF and VA software.
