Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. C & B has a Joint State Advisory Service, whereby it sends states memoranda on developments in federal law pertaining to Medicaid, Medicare, and other health and social services programs. C & B is the only law firm with extensive experience representing and advising multiple states on Medicaid matters. This national experience and perspective, together with the firm's experience negotiating with, and litigating against, CMS on behalf ofstates, gives it unique expertise and knowledge that attorneys for OPWDD, Department of Health, the Governor's Office or other state agencies do not have.
