Single Source Procurement: Asthma Control Program

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The American Lung Association (ALA) is the sole source vendor for the AMSSI due to extensive infrastructure, resources and nationally renowned expertise in asthma management training and school-based asthma self-management education. ALA is the leading organization in the United States providing education to the public on lung health, including asthma, COPD, influenza, and lung cancer, tobacco and air quality, and has a history of established success in implementing school-based services strategies nationally and in NYS. ALA is solely qualified and uniquely positioned to fulfill AMSSI deliverables through existing evidence-based asthma education curricula and resources that are currently owned, trademarked and copyrighted by the ALA, including the only evidence-based ASME curriculum.
