Single Source Procurement: Administration of New York’s Nurse Aide Testing and Certification Programs
Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The New York State Department of Health Nurse Aide Registry Program has made a determination to issue a Single Source Procurement to Prometric, Inc to support ongoing currently funded projects.
Federal Law requires nurse aides used by nursing homes to complete a state-approved training program and demonstrate competency. To ensure compliance with federal law, the Department established the NYS Nurse Aide Registry [Public Health Law section 2803-j]. The state Nurse Aide Registry lists individuals who complete the training program.
A competitive procurement was not feasible because the Department of Health has been unable also to manage the undertaking and development of a new formal competitive procurement prior to the contract ending. The Department originally contracted with the current vendor through RFP #15917. A contract extension is needed to prevent a gap in services until a new contractor can be competitively selected. The contractor is uniquely positioned to continue the services it has successfully performed during the current contract period.
