Single Source Procurement: Newborn Screening Program

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. Due to the proprietary nature of the Luminex xTag system software, components and application, only Luminex can provide the materials required. No other alternative exists. Luminex has provided a sole source letter that states their products can only be run on the Luminex System and that no other entity is authorized to sell the Luminex products.
