Single Source Procurement: Adult Homes Class Members Assessments

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. DOH now seeks a second amendment of the contract, adding value and extending the final term to February 28, 2019 to account for the assessments and related activities that were needed for TSINY to complete its work for the state. Although TSINY’s work was expected to be completed by December 31, 2018, there were factors that contributed to an ongoing need for their services. First, due to the Temporary Restraining Order (TRO) that was placed on DOH adult home regulations, there were more assessments needed than originally anticipated as more individuals who were potentially class members were admitted to the adult homes under the Settlement. Additionally, while three housing contractors began assuming assessments in April of 2018.
