Single Source Procurement: Organ Transplant & Donation Services

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The Organ Donation/Transplant unit, in the Division of Hospitals and Diagnostic & Treatment Centers, is responsible for carrying out the Department of Health's mandates under Article 43. This includes staffing the NYS Transplant Council which advises the Commissioner of Health on all matters regarding organ/tissue donation and transplantation and the admiration/promotion of the NYS Donate Life Organ and Tissue Donor Registry. The unit also carries out quality improvement and oversight of organ transplant programs as required by 10NYCRR 405.22.

Since 1988, the Department has provided grants to two organizations that assist in meeting the needs of this project: the New York Center for Liver Transplant (NYCLT) and the New York Alliance for Donation (NYAD). NYCLT's purpose is to monitor the quality of care delivered to recipients and living donors receiving liver transplant services in New York State. NYAD's purpose is to increase organ, eye and tissue donation by enhancing public and professional awareness through on-going education, outreach and promotion of the Donate Life Registry. These organizations are specifically named in the enacted state budget to support this project, therefore a single source procurement is appropriate.
