Single Source Procurement: Refrigeration Equipment Maintenance and Service

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The New York State Department of Health, Wadsworth Center has made a determination to issue a Single Source Procurement to Johnson Controls. The contract provides refrigeration Equipment Maintenance and Service. The critical nature of the Center’s work with public health in the areas of environmental health, infectious diseases, and newborn screening relies on the continual maintenance and repair of laboratory freezers to ensure the safety of non-replaceable medical and scientific materials. The Center has no alternative resources for this service. Therefore, it is not feasible to consider transferring these services to a different vendor for such a short period of time while awaiting internal approvals to award a new contract.
