Single Source Procurement: Maintenance Contract

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. Illumina is the only vendor that can provide the required services. No other vendors exist that can provide the OEM parts and supplies required for the maintenance and post-repair testing of the equipment. As part of the service agreement, Illumina provides telephone technical support and will replace sequencing supplies if a problem is caused by instrument malfunction or defective sample loading supplies, even if no onsite repair is required. No other vendor could provide this part of the service because Illumina supplies are proprietary.
