Single Source Procurement: Integrated Breast, Cervical and Colorectal Cancer Screening Program

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The Integrated Breast, Cervical and Colorectal Cancer Screening Program (CSP) initiative works to promote and provide comprehensive, guideline-concordant breast, cervical and colorectal cancer screening services among age-appropriate populations in the state, and provide comprehensive screening and diagnostic services to eligible uninsured and underinsured men and women.

The CSP screening contractors develop relationships with providers (e.g., hospitals, clinics, health care providers, clinical laboratories) and community-based organizations to conduct outreach to priority populations and to provide screening, diagnostic and case management services, public education, data management and quality assurance. The contractor and its partners also assist eligible individuals diagnosed with breast, cervical, colorectal or prostate cancer to obtain prompt, comprehensive treatment through the New York State Medicaid Cancer Treatment Program (MCTP).

CSP screening contractors interact with and enter into written agreements with health care providers and clinical laboratories to offer eligible clients cancer screening and diagnostic services and reimburse those health care providers and clinical laboratories for provision of those services to eligible clients. The Department provides guidance to CSP screening contractors and providers for eligibility and reimbursement for appropriate cancer screening and diagnostic services in the CSP Operations Manual. The CSP screening contractors provide the CSP Operations Manual and the established reimbursement fee schedule referred to as the Maximum Allowable Reimbursement Schedule (MARS) to participating health care providers and clinical laboratories annually and as revisions are made. CSP screening contractors also work with the Department to implement internal control systems and strategies to ensure that health care providers and clinical laboratories participating in the screening program are appropriately credentialed, that clients meet eligibility requirements, and that reimbursement is made only for eligible services.

Contractor scope of work includes activities in the following areas:

  1. Program Management and Leadership - coordinate and administer the program to ensure that all required activities are implemented and that contractual obligations are met in a timely manner.
  2. Partnering, Coordination and Collaboration - build and maintain collaborative relationships with health, human service, education and other community organizations to provide and promote utilization of cancer screening services at the population level and among the eligible populations throughout the proposed service region.
  3. Public Education, Targeted Outreach, and Inreach - engage partners to implement evidence-based or evidence-informed strategies to promote the program, build public demand for cancer screening services, and identify eligible clients in priority populations, throughout the service region.
  4. Provision of Health Services: Screening, Diagnostic, and Case Management Activities - develop a network of medical care providers throughout the service region to provide eligible men and women with comprehensive, guideline-concordant breast, cervical and colorectal cancer screening and diagnostic services, and, when necessary, ensure access to treatment services.
  5. Data Management - oversee the collection of all data required by the NYSDOH.
  6. Fiscal Management.

The Department of Health Bureau of Chronic Disease Control (BCDC), Cancer Services Program requests approval to extend thirty-six Integrated Breast, Cervical and Colorectal Cancer Screening Program infrastructure contracts scheduled to end 3/31/18 for six months to end 9/30/18. These contracts were established as simplified renewals however, the Department requests approval to process amendments to the 4/1/15-3/31/16 simplified renewal contracts to extend to 9/30/18, add six months of funding and convert to multi-year contracts.

In addition, this request seeks to extend thirty Integrated Breast, Cervical and Colorectal Cancer Screening Program clinical contracts also scheduled to end 3/31/18 for six months to end 9/30/18 at no cost. The clinical contracts are multi-year agreements and need to be amended to extend to the end of the procurement period.

These requests will allow the Department to comply with Budget Bulletin H-1032 Revised and will reduce the number of transactions that need to be processed. A competitive procurement is planned to release in October 2017 in order to establish new multi-year contracts with five-year periods by 10/1/18.

The thirty-six infrastructure and thirty clinical, Integrated Breast, Cervical and Colorectal Cancer Screening Program contracts were competitively selected by two request for applications (RFA #1209120315 and #1401130108).
