Sole Source Procurement: Cancer Surveillance, Education and Control Initiative

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The New York State Department of Health (NYSDOH), Center for Community Health, Division of Chronic Disease Prevention, is seeking approval to enter into a Sole Source agreement with Roswell Park Cancer Institute for the purpose of providing a variety of services associated with the Cancer Surveillance, Education and Control Initiative. The multi-year term of proposed contract C028506 is December 16, 2013 through to and including September 29, 2018. The total cost of the proposed contract is $43,193,641.00.

Under Public Health Law, cancer reporting has been mandated since 1940, with this mandate being fulfilled through the activities of the New York State Cancer Registry (NYSCR). With the passage of the Cancer Research Improvement Act of 1997, the scope of the NYSCR's mandate was broadened to include additional quality, education, prevention, surveillance and cancer control activities. The Cancer Surveillance, Education and Control Initiative supports these additional requirements while maintaining patient confidentiality and individual privacy. Sections 2400 and 2401 Article 24 of the Public Health Law outline a number of provisions that are directly applicable to activities under this Initiative.

The Cancer Surveillance, Education and Control Initiative, through a sole source contract with Roswell Park Cancer Institute (RPCI), will continue to enable the Department of Health to fulfill its mandates under Sections 2400, 2401 and 2402 of the Public Health Law.
