Single Source Procurement: Eat Well Play Hard Child Care Settings Extension (EWPHCCS)
Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.
The Division of Nutrition (DON) is requesting a single source waiver from competitive bidding requirements to amend and extend six EWPHCCS contracts (C027137 through C027142) for an additional 12 month period. The current five-year contracts end on September 30, 2016, however a separate EWPHCCS contract with the New York City Department of Health and Mental Hygiene (NYCDOHMH) (C027896), procured through a Waiver Request in March of 2012, will not end until September 30, 2017. The NYCDOHMH EWPHCCS contract includes specific deliverables to provide Just Say Yes to Fruits and Vegetables (JSY) activities at the Stellar Farmers Markets. The next JSY Stellar Farmers Markets Request for Applications (RFA) is under development and expected to be released this fall. The current waiver request is necessary to align both EWPHCCS procurements on the same cycle for the next competitive procurement that will be posted on the Grants Gateway in August 2016. Applications in response to the EWPHCCS Request for Applications (RFA) will be due in November 2016. Contracts resulting from this RFA will be for five years with no annual renewals. Ending the NYSDOHMH contract a year early is not an option due to the JSY component of that contract.
Contractors were awarded contract(s) as a result of the competitive procurement process. This is a 12 month extension of the contract(s) under the same terms, conditions, and pricing authorized under the existing contract(s). The single source extension period will allow for the continuation of critical services pending outcome of a new competitive procurement to obtain these services.
