Single Source Procurement: Hearing Reporter Services

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The Department of Health Office of Professional Medical Conduct (OPMC) and the Bureau of Adjudication (BA) within the Division of Legal Affairs require hearing reporter services for the recording of disciplinary proceedings in matters of professional medical conduct pursuant to Public Health Law Section 230 and Education Law Section 6530, 6531 and 6532. In addition to OPMC hearings, the Department of Health conducts administrative hearings in other subject areas where it has regulatory authority.

The current contractors, Precise Court Reporting C026678, Action Reporting Service C026684, Jack Hunt and Associates C026680 & C026685 provide hearing reporter services at designated Department of Health administrative hearings. The Department of Health requested and received a Contract Reporter Exemption Request for a 3-month extension of their current contracts, which expire on September 30, 2015. This additional time is necessary for the continuation of services until our next contracts are approved and in place. The estimated date for contract approval of the next contracts will be past the expiration date of the current contracts.

The listed vendors were all selected through an approved evaluation of bids received in response to an Invitation to Bid. The Department of Health has been using the services of these contractors since the start of their contracts on October 1, 2010. Approval of our exemption request from advertising in the Contract Reporter enables the Department of Health avoid a period of time without approved hearing reporter contractors, as these services are essential to OPMC and the Department.
