Single Source Procurement: Community-Based HIV Primary Care and Prevention Services

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The overall goal of this initiative is provide pre-exposure prophylaxis (PrEP) to those at highest risk of contracting the HIV virus in order to keep them HIV negative. In June 2015, NYSDOH requested to extend the PrEP Specialist funding for the period 10/1/15-6/30/16 (9 months) on the current Primary Care contracts in order to avoid a gap in services while a PrEP Specialist RFA is being developed/processed for this initiative.

One of the contracts awarded in this initiative was to Suffolk County. However, Suffolk County has been in the process of transitioning its primary care/PrEP services to Hudson River Healthcare Inc., which was offering these services as a subcontractor to Suffolk County.

NYSDOH AIDS Institute is transferring contract #C026242 with Suffolk County Department of Health to Hudson River Healthcare, Inc. effective 10/1/2015. Suffolk County has been transitioning its primary care patient services and PrEP services to Hudson River Healthcare Inc. for some time and has recently completed the transition. The county will no longer offer these services and no longer wants to administer the subcontract with Hudson River Healthcare, Inc.

Reasonableness of cost: The budget and costs associated will remain the same as they are under the current agreement. The majority of the funds will cover salary costs/fringe and the balance of the contract supports OTPS costs to carry out PrEP activities.
