Single Source Procurement: Blinded Seroprevalence Study

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health (NYSDOH) is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The NYS Department of Corrections and Community Supervision (DOCCS) issued a Request for Proposal (RFP) in 2014 to solicit bids for systemwide lab testing services in prison facilities. Bio-Reference was competitively selected as the awardee for a five (5) year contract in 2015. As part of its memorandum of understanding with DOCCS, NYSDOH AI must use the same laboratory services provider because it’s the only entity gathering prisoner blood specimens for normal care and treatment of the incarcerated population. In June 2020, DOCCS extended its current contract with Bio-reference Laboratories, Inc. for an additional two (2) years for testing inmate specimens. For the NYSDOH to complete its inmate study, delayed by COVID-19, as additional year is needed.
