Gestational Surrogacy Program Complaint Process

The New York State Department of Health (Department) licenses Gestational Surrogacy Programs (GSPs) in New York State and enforces specific legal protections for gestational surrogates that will help ensure that surrogacy agreements are ethical and fair to all parties involved. GSPs and Assisted Reproductive Technology Service Providers (ARTSPs) are required to follow regulations to protect the health and safety of the surrogate, the egg donor and the children born under gestational surrogacy agreements.

The Department is responsible for investigating complaints against GSPs and complaints that a person or business is acting as a GSP without a license in New York State. The Department will keep your complaint confidential; however, we require that you include your name and phone number in case we need to contact you for additional information. Generally, only those complaints concerning issues that occurred within the past year will be considered.

Complaints must be submitted in writing on the attached form and must include detailed information accompanied with any evidence to support the allegations in the complaint. In order to process your complaint in a timely manner, please:

  • Type or Print clearly
  • Complete the form in its entirety, including your contact information
  • Include names and phone numbers of any corresponding contacts or witnesses
  • Attach copies of paper materials that support your concern
