Preparing for Adopt, Implement, or Upgrade (AIU) Attestation

1. Maintaining Eligibility

Hospitals must meet all eligibility requirements before being able to attest as an eligible hospital (EH) in the NY Medicaid EHR Incentive Program.

The requirements include the following:

  • Must be an Acute Care or Children´s Hospital
  • Must meet the Medicaid patient volume threshold (where applicable)

2. Participation Requirements

Eligible hospitals (EH) attesting for Participation Year 2-3 (MU1) of the NY Medicaid EHR Incentive Program must maintain all participation requirements.

The requirements include the following:

  • Must be enrolled as NY Medicaid fee–for–service provider
  • Must have an ETIN to maintain Medicaid enrollment

3. Adopt, Implement, or Upgrade to a Certified EHR Technology

To be eligible to receive the NY Medicaid EHR Incentive for Participation Year 1, an eligible hospital (EH) may adopt, implement, or upgrade (A/I/U) to ONC Certified EHR Technology in the current payment year.

Adopt Implement Upgrade
Acquire, purchase, or secure access to a CEHRT
  • Requires either installation of the certified EHR technology OR a financial commitment to purchasing or using the EHR
  • Does NOT require that the technology be in use in the clinical setting
Install or commence utilization of certified EHR technology
  • Qualifying activities include integration, training, and data transfer
Expanding functionality of existing certified EHR, or moving from non-certified to certified version
  • Requires installation OR a financial commitment to purchase or use the certified version

Obtaining an ONC Certified EHR Number

The NY Medicaid EHR Incentive Program attestation portal requires that all EPs provide a certified EHR number. Certified EHR numbers are distributed though the ONC Certified HIT Product List (CHPL) website.

4. Registering for the NY Medicaid EHR Incentive Program

Once eligibility requirements and program prerequisites have been met, an eligible hospital (EH) can then go to the CMS Registration and Attestation System to register for the NY Medicaid EHR Incentive Program as a Medicaid-only hospital or dually–eligible hospital.

5. Attesting AIU

Once the NY Medicaid EHR Incentive Program welcome letter is received (Step 3), the Medicaid-only or dually–eligible hospital must log into the attestation portal to complete their attestation to the NY Medicaid EHR Incentive Program. EHs will be required to review their Federal Information, fill out the eligibility section and complete the attestation requirement, which includes printing, signing, and mailing the PDF of their attestation. Before completing these two sections, NY Medicaid highly recommends that hospitals prepare by completing the NYS Hospital Workbook.

  1. Program Eligibility
    This section determines if an acute care hospital meets the minimum eligibility requirement for the EHR Incentive Program. Children's hospitals are automatically qualified for the program based on the federal guidelines.   2. Incentive Payment
    Incentive payment amounts are unique to each EH and will vary based on hospital criteria, including discharge volume and Medicaid bed days. To estimate your incentive payment, please use the NYS Hospital Workbook.

6. Pre–payment Review

All eligible hospital (EH) applications for the NY Medicaid EHR Incentive Program are subject to review and approval to verify that the applicant has met program eligibility requirements. Following attestation and prior to payment, New York Medicaid performs a review of each EH's attestation. This review occurs each year the EH participates in the NY Medicaid EHR Incentive Program.

If additional information is needed, New York Medicaid will initially contact the EH via the email address registered with the Center for Medicare and Medicaid Services (CMS). However, New York Medicaid may also contact the EH via the phone number registered with CMS.

Pre–Payment Review:

  • An eligible hospital (EH) may be contacted at the email address registered with CMS. The EH contact should ensure that the email address registered with CMS is a valid email address and be sure to check it on a regular basis
  • Failing to respond to a program outreach may result in attestation rejection

7. Incentive Payment

The NY Medicaid EHR Incentive Program review timeline varies, as it is dependent on volume of attestations and also on validation failures. However, please note that attestations are generally processed in the order received and every effort is made to expedite the review process so payment can be made.

The eligible hospital´s (EH) incentive payment will be disbursed as a lump sum payment in the weekly Medicaid payment run following CMS final approval. The incentive payment will be released using existing channels and processes for paying Medicaid fee-for-service providers.
