The CON Process

Certificate of Need Applications are reviewed as follows:

The initial review is conducted by the Department of Health staff in the following areas:

  • Public Need
  • Financial Feasibility
  • Character and Competence and Program
  • Architectural and Engineering
  • Legal

The Department staff makes a recommendation to the State Hospital Review and Planning Council's Project Review Committee and so does the Health System Agency (HSA) if applicable.

The State Hospital Review and Planning Council Project Review Committee makes their recommendation to the full State Hospital Review and Planning Council.

The State Hospital Review and Planning Council is an advisory body that reviews the application and makes their recommendation either to the Commissioner of Health or the Public Health Council, depending on the type of application.

If the application is for construction and/or a change in a service, the State Hospital Review and Planning Council's recommendation along with the application, is sent to the Commissioner of Health. The Commissioner of Health makes the final decision on these applications.

If the application involves the establishment or a change in ownership, the State Hospital Review and Planning Council's recommendation, along with the application, is sent to the Public Health Council's Establishment Committee for a recommendation. These applications are then sent with the Public Health Council's Establishment Committee's recommendation to the full Public Health Council. The Public Health Council is the final decision makes on these applications.
