Single Source Procurement: Comprehensive Family Planning and Reproductive Health Care Services

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The Bureau of Maternal & Child Health (BMCH) requests approval to add funding to contract C027025 with Hudson River HealthCare, Inc. (HRHCare) for each of the following two contract periods: January 1, 2014 through December 31, 2014, and January 1, 2015 through December 31, 2015. The funds will support the provision of comprehensive family planning and reproductive health care services for low-income residents of Suffolk County. The funds will be transferred from contract C027057 with Suffolk County Department of Health Services (Suffolk County DOH) due to the circumstances described below.

Earlier this year, Suffolk County DOH initiated discussions with the NYS Department of Health regarding the difficulty of maintaining the operation of the Kraus Family Health Center at Southampton (Southampton HC) due to ongoing financial difficulties at the County level. As an approved federally qualified health center (FQHC), HRHCare has demonstrated its ability to ensure that the quality of care and provision of services to under and uninsured individuals is maintained. As a result, the Suffolk County DOH initiated discussions with HRHCare to take over services and operate the Southampton HC. Due to funding being transferred from one active contract to another, there will be no net increase in the expenditures of this program.

BMCH determined that HRHCare was the best option to operate the Southampton HC clinic due to the following factors:

  • HRHCare was awarded funding through the same competitive procurement as Suffolk County DOH, Comprehensive Family Planning and Reproductive Health Care Services (RFA # 0909151050);
  • HRHCare is the only approved FQHC on Long Island. Currently, HRHCare operates more than 20 primary care sites and serves approximately 90,000 patients annually throughout New York State's Hudson Valley and Long Island regions;
  • HRHCare is a long-time family planning contractor with a successful track record of managing a multi-county family planning program; and
  • HRHCare provides a comprehensive range of other services (e.g. primary care, prenatal/postpartum care) that would be readily available to family planning patients thus enhancing the comprehensive nature of the care provided to patients.

Due to the critical nature and need for family planning services in this community, BMCH determined that having HRHCare assume the operation of the clinic is the best solution to ensure the continued delivery of services, with minimal disruption, to current and future family planning patients served at the site. Staff from the Office of Health Systems Management (OHSM) are working with Suffolk County DOH and HRHCare on the transfer of clinic operations. The program will be located in a newly renovated state-of-the-art facility on the campus of Southampton Hospital, in very close proximity to the current clinic location. When the Certificate of Need is approved by OHSM, HRHCare will assume ownership of the clinic site with no financial benefit to Suffolk County DOH.
